Every reputable organization has terms and conditions that guide their business practices. And while some may elect to bury theirs in the fine print, we believe that good business relationships are built on understanding. That's why our terms and conditions are right up front, right here.

Swagville is a division of iStorm, Inc. All billing will come from, and payments should be made to iStorm, Inc. In rare cases, billing may originate from our suppliers.

Minimum Orders
It's true that prices go down as quantities go up. But what if you don't want a bazillion of something? Heck, you might not even need 100!

If you need less that the minimum quantity shown, call us or drop us an email. We'll get in touch with the manufacturer and do a little arm-twisting for you. Sometimes they're really nice about less-than-minimum quantities. But there are some that old stick-in-the-muds and there isn't a darned thing we can do to change their minds. (If that's the case, we will immediately send our crew to TP their house.)

Even if we can't get the quantity you want, there's a pretty good chance that we'll be able to find what you're looking for in the quantities you need. Either way, let's see what we can do.

Order Changes and Cancellations
We understand - really. Here's the deal: If you make a change or cancellation before the order goes into production, we're in good shape.

If your order is already in production, you are responsible for any and all charges for order processing, creation of artwork, preparatory materials and production to the time that iStorm, Inc. is reasonably able to cancel or change your order. You agree that all completed work and costs incurred to process your order are your responsibility.

Clothing Sizes
Sizes vary from manufacturer to manufacturer and most people lie about their waistline. (By the way, everyone at Swagville is perfectly proportioned and unbelievably good looking, so we never have that problem.)

Some items are sized for women, some for men, some unisex, but hardly any unicorn. Call us if you have questions about sizes, we'll get in touch with the manufacturer and get the information you need. For more information about clothing sizes, see "Clothing Sizes"

Prices
Pricing on the Swagville website is continually being updated to reflect the most current pricing. These updates are furnished by our suppliers. There may be instances when the pricing shown on the website is current. We verify pricing before processing any orders. If there is a variation in price, we'll let you know prior to processing your order. We reserve the right to change prices at any time.

Warranties
iStorm, Inc. warrants that all goods sold are free of any security interest and will make available to you all transferable warranties made to us by the manufacturer of the goods. iStorm, Inc. makes no other warranties, express or implied.

Product Photos and Specifications
Product photos and specifications on our website are furnished by suppliers. Every effort is made to represent products as accurately as possible. It is important to remember that photos and specifications are not a substitute for your evaluation of a representative sample. We strongly recommend that you request a sample prior to your order. If you elect not to evaluate a sample, we are not responsible for variations in appearance, specifications, quality, materials, and suitability.

Merchandise Suitability and Consistency
It's always a good idea to receive a sample of any items before you place your order. It is your responsibility to request samples and evaluate the representative sample for quality, functionality, and suitability for the products' intended use. Samples are representative of the merchandise that you will receive and as such, there may be some variation in materials, production processes, and colors as a result of variations in all material and manufacturing processes.

You agree that by placing an order, you will accept merchandise based on your evaluations and will accept variations in manufacturing, materials, color and packaging.

Quantities, Overages and Shortages
Due to printing and manufacturing processes, production speeds, and quality control, the quantity of items shipped may vary from the quantity ordered. Industry standards consider variations in quantities of +/- 10% as acceptable and your invoice will be adjusted to reflect the actual quantity shipped. If you need an exact quantity, there is an "exact count" fee which to which you must accept prior to ordering.

Acceptance of Orders
By submitting an order of any kind to iStorm, Inc. you agree to be bound to the terms and conditions contained herein. Any exceptions to these terms and conditions must be submitted in writing prior to our processing of your order. Your receipt and retention of the goods shall constitute acceptance of the order, subject to the terms and conditions contained herein. You and iStorm, Inc. agree that any contract hereby entered into has been made and is to be construed to Nebraska State Law.

Returns
Returns happen - but very rarely. First, let's talk about making sure you're getting what you want. We're here to help you find the right promotional products. We know who the best manufacturers are and we know who to avoid. Of course, we'll do our best to guide you through the maze.

Samples: If you have any doubts about the suitability, qualities, or features of a product, ask us for a sample before you place your order. Sometimes the samples are free. Most of the time, there is a charge for the sample. Even so, it's better to be sure.

We suggest opening your shipment right away so that you can inspect it before the return period is over. Under no circumstances can we accept returns unless we are notified of the problem within 10 days of receipt.

Engraved, embroidered or otherwise "personalized" items, as well as edible items cannot be returned unless damaged during shipment or received defective (exchange for exact items only). Any item that is received damaged in shipment or manufacturer defective must be reported within 10 days and will be exchanged for you without charge. Damage during shipment is the responsibility of the carrier and you must file a damage claim with the carrier that delivered your merchandise. We do not accept unauthorized returns. If you need to return something, you must get a return authorization number (RMA) from us by calling 402-537-0067. You must mark each box with "RPN-(YOUR ORDER NUMBER)". For example, Order number 12345 would be marked "RMA-12345" on each box. (We can't accept returns that are not properly marked.) All returned items must be shipped back in their original boxes including packing material. PLEASE INSURE ALL RETURNS. Return postage and shipping costs are not refundable. We do not accept unauthorized returns.

Shipping Information
Be sure that the shipping address that is given to us is accurate and deliverable by UPS. It is the customer's sole responsibility to ensure receipt of the package that is left at the door. UPS may choose to leave packages at the door. If that's the case, timely pickup and safekeeping is your responsibility. Additional fees will be charged for incorrect addresses listed on the order, or for any change of address once the order has shipped. We assume no liability for packages left at the door. It is highly recommended that someone is available at the shipping address to sign for the package. Because of the variety of items we carry, your order will probably be shipped directly from the manufacturer. Your order might arrive in multiple shipments. We are not responsible for shipping delays, damaged shipments, or damages that arise from delay in delivery, Acts of God, or other circumstances that are not in our direct control.

Transfer of Ownership
All orders are shipped FOB. You own the merchandise immediately on acceptance by the carrier.

Special Offers
We love special offers and want you to use them often to promote your business. There are a few terms that allow us to continue offering specials.

  1. Offers are for standard pricing as shown on our website.
  2. Special offers may not be combined with any other offers.
  3. Orders on special offers may not be combined into a single order.
  4. Special offers are for the price of merchandise only. Art preparation, taxes, and shipping are not subject to special offers unless specifically stated in the terms of the offer.
  5. Special offer codes, coupons, or other redemption devices must be presented at the time of your order.
  6. Special offers may not apply to some items. Please check with us before ordering.
  7. Special offers may be withdrawn at any time and are subject to availability.
  8. Special offers may be limited to one per customer.

Payment: Credit Card, Checks, Money Orders, or Cashier's Checks
We accept VISA, MasterCard, Discover and American Express credit cards. Your transactions are secure. Orders placed here are encrypted and transmitted through a Secure Socket Layer (SSL), the most advanced security technology available on the internet today. Under the Fair Credit Billing Act, we promise to protect you from unauthorized charges to your credit card as a result of shopping with us. Orders will be processed on verification of payment from the credit card, or in the case of checks, once the check has cleared. There is a $50.00 fee for all returned checks. We aggressively pursue prosecution in cases of fraud.

Payment Terms
Unless otherwise approved by iStorm, Inc. all payments are due at time of order. If your account is granted payment terms, you agree to pay your invoice on or before the due date. Overdue invoices are subject to monthly finance charges of 1.5%, or the maximum charge as allowed by law. You agree to pay all of our reasonable fees incurred for any collection actions.

Taxes
We are required by law to collect all applicable sales taxes. Please check with your tax advisor for specific tax requirements. If you are exempt from sales tax, you must provide us with a copy of your exemption certificate or resale certificate.
